This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of the domain name https://winpaytech.com including the related mobile site and mobile application, hereinafter referred to as the Platform.

In these Terms of Use, “Platform Owner”, “we”, “us”, “our”, and “WinPayTech” refer to WINPAY TECHNOLOGIES PRIVATE LIMITED. “You”, “your”, or “user” shall mean any natural or legal person who accesses, browses, registers on, transacts through, or uses the Platform.

1. Acceptance of Terms

Your use of the Platform and services and tools are governed by these Terms of Use, including applicable policies incorporated herein by reference. If you transact on the Platform, you shall also be subject to policies applicable to such transaction. By using the Platform, you enter into a legally binding agreement with the Platform Owner.

Any terms and conditions proposed by you that are additional to or conflict with these Terms of Use are expressly rejected by the Platform Owner and shall be of no force or effect.

2. Modification of Terms

These Terms of Use may be modified at any time without assigning any reason. It is your responsibility to periodically review these Terms to stay informed of updates. Continued use of the Platform after changes are posted shall mean that you accept the revised Terms.

3. Services Offered

WinPayTech may provide digital payment services, mobile recharge, DTH recharge, utility bill payments, tuition fee payments, rent payments, payment gateway-enabled transactions, customer support tools, rewards, promotional offers, and other financial technology services as may be made available from time to time.

We reserve the right to add, modify, suspend, restrict, or discontinue any service at any time, subject to applicable law and partner/provider policies.

4. User Registration and Account Responsibility

To access and use certain Services, you may be required to register or authenticate using your mobile number, email address, OTP, or other verification method. You agree to provide true, accurate, current, and complete information during and after registration.

• You shall be responsible for all acts performed through your registered account.
• You shall keep your account credentials and OTPs confidential.
• You shall immediately notify us of any unauthorized use or suspected breach of your account.
• You shall not create multiple accounts to misuse offers, promotions, rewards, or payment services.

5. OTP and Electronic Authentication

OTPs and authentication codes sent to your registered mobile number or email are confidential. WinPayTech will never ask you to share your OTP. Any transaction or action completed using valid authentication may be treated as authorized by you.

6. Payment Processing

Payments on the Platform may be processed through authorized third-party payment gateways, banking partners, UPI providers, card networks, financial institutions, BBPS providers, recharge providers, and other service partners. By initiating a payment transaction, you authorize WinPayTech and its payment partners to process the transaction on your behalf.

You agree that payment failures or delays may occur due to:

• Banking or payment gateway downtime
• UPI, card network, or net banking issues
• Incorrect details entered by the user
• Insufficient balance or authorization failure
• Provider, operator, or biller system downtime
• Technical issues beyond our reasonable control

WinPayTech shall not be liable for failures, reversals, or delays caused by banks, payment gateways, telecom operators, billers, service providers, or other third-party systems.

7. Transaction Accuracy

You are responsible for verifying all transaction details, including mobile number, consumer number, biller information, amount, recipient details, and payment method before confirming a transaction. Transactions successfully processed using details entered by you may not be reversible.

8. Charges and Fees

You agree to pay all applicable charges, service fees, convenience fees, taxes, or other amounts associated with availing the Services. Applicable charges may be displayed before transaction confirmation wherever required.

9. Refunds and Cancellations

Refunds, cancellations, and reversals shall be governed by our Refund Policy, payment gateway policies, banking partner timelines, operator/biller rules, and applicable laws. Refunds may not be available for every successful transaction or user error.

10. Rewards, Cashback, and Promotional Benefits

WinPayTech may offer rewards, cashback, loyalty benefits, referral offers, coupons, or promotional credits. Such offers may be subject to separate terms, eligibility criteria, expiry dates, transaction limits, and usage restrictions.

• Rewards may not be transferable or redeemable for cash unless expressly stated.
• WinPayTech may modify, withdraw, cancel, or reverse offers in case of fraud, abuse, system error, or policy violation.
• Promotional benefits are provided at the sole discretion of WinPayTech or its partners.

11. Prohibited Activities

You agree not to use the Platform or Services for any unlawful, illegal, fraudulent, abusive, or prohibited purpose, including but not limited to:

• Using fake, misleading, unauthorized, or incorrect identity details
• Attempting unauthorized transactions or fraudulent activities
• Misusing offers, rewards, cashback, or referral benefits
• Interfering with servers, databases, security systems, or platform operations
• Copying, scraping, reverse engineering, or commercially exploiting platform content
• Using bots, automation, scripts, or unauthorized tools
• Violating any applicable Indian or local laws

12. Fraud Prevention and Monitoring

WinPayTech reserves the right to monitor accounts and transactions for fraud prevention, suspicious activity detection, risk management, compliance requirements, and platform security. Transactions identified as suspicious may be delayed, restricted, cancelled, reviewed, or reported to appropriate authorities where required under applicable law.

13. Account Suspension or Termination

WinPayTech may suspend, restrict, or terminate access to your account or Services without prior notice if fraud, suspicious activity, violation of these Terms, legal requirement, regulatory instruction, payment abuse, or platform risk is detected.

14. No Warranty

Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness, reliability, availability, or suitability of the information, materials, goods, or Services offered on the Platform for any specific purpose. You acknowledge that such information and materials may contain inaccuracies or errors, and we expressly exclude liability for such inaccuracies or errors to the fullest extent permitted by law.

15. Use at Your Own Risk

Your use of the Platform and Services is solely at your own risk and discretion. You are required to independently assess and ensure that the Services meet your requirements before using them.

16. Intellectual Property

The contents of the Platform and the Services, including design, layout, look, appearance, graphics, logos, text, software, workflows, and features, are proprietary to WinPayTech or licensed to us. You shall not claim any intellectual property rights, title, or interest in such contents.

17. Third-Party Services and Links

The Platform may integrate with or contain links to third-party websites, payment gateways, banks, telecom operators, recharge providers, BBPS providers, APIs, analytics providers, and financial institutions. On accessing third-party links or using third-party services, you may be governed by their respective terms, privacy policies, and other applicable policies.

Such links are provided for convenience and further information only. WinPayTech does not control third-party systems and is not responsible for their downtime, failures, errors, policies, or service quality.

18. Electronic Consent and Communications

By using the Platform, you consent to receive communications, notices, records, disclosures, transactional alerts, service updates, and agreements electronically through the Platform, email, SMS, WhatsApp, push notification, or other electronic means.

19. Indemnity

You shall indemnify and hold harmless the Platform Owner, its affiliates, group companies, officers, directors, agents, employees, partners, and service providers from any claim, demand, action, penalty, loss, liability, cost, or expense, including reasonable attorney fees, arising out of your breach of these Terms, Privacy Policy, other policies, violation of applicable law, misuse of the Platform, or infringement of third-party rights including intellectual property rights.

20. Limitation of Liability

To the maximum extent permitted by law, WinPayTech shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from the use or inability to use the Platform or Services, transaction failures, delays, third-party outages, unauthorized access, loss of data, loss of rewards, or any matter beyond our reasonable control.

21. Force Majeure

Notwithstanding anything contained in these Terms, the parties shall not be liable for failure to perform any obligation if such performance is prevented, restricted, or delayed by a force majeure event including natural disasters, acts of government, regulatory actions, war, strikes, internet failure, banking network failure, payment network outage, cyber incidents, or events beyond reasonable control.

22. Privacy Policy

Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to collection, storage, processing, and use of information in accordance with the Privacy Policy.

All concerns, notices, or communications relating to these Terms must be communicated to us using the contact information provided on the Platform.

24. Governing Law and Jurisdiction

These Terms and any dispute or claim relating to them, their enforceability, or your use of the Platform shall be governed by and construed in accordance with the laws of India.

All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Hyderabad, Telangana, India.

25. User Consent

By accessing, browsing, registering, transacting, or continuing to use WinPayTech, you acknowledge that you have read, understood, and agreed to these Terms of Use, Privacy Policy, Refund Policy, and other applicable policies available on the Platform.
